The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe experienced widespread relief on Monday, as the tension sparked by the presentation of a new 28-article proposal for achieving ceasefire appeared – temporarily – to have been contained. A Washington representative spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its countermove: another massive barrage of aerial bombardment on Kyiv.

The Pattern of Diplomacy and Destruction

The chain of opposing developments captured the harsh reality of the outgoing year. By day, diplomatic battles are waged: optimistic declarations are issued from multiple capitals. Significant resources is expended on containing particular approaches. By night, Russian leadership brutally reminds the world that, for them, military action persists as the main instrument for achieving "settlement".

Nighttime Reality

As military strikes unfolded into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was revealed. Ukraine is able to track projectile deployments from across the border, a capacity provided through current data. From observation points, military aircraft that had been dispatched to engage hostile cruise missiles flew past – sophisticated military planes supplied to Ukraine by Western partners.

Shortly after, Kyiv's anti-aircraft weapons activated: multiple launches fired to intercept a hostile projectile. This was a sophisticated defense system at work, probably provided by Western nations. Every deployment creates sudden vibrations, shaking the windows. The brief panic quickly becomes resigned acknowledgment: perhaps the hostile projectile won't strike its target this time, sparing the city from devastation and another blackout.

Continuous Dangers

Following this, a automatic firearm opened up on a drone somewhere nearby, part of a rapid response unit – probably allied-provided weaponry. Unfortunately, the bullets missed the hostile drone – it continued its flight toward its destination.

With pauses, this carried on until dawn. Kyiv faced the daybreak reports: seven people killed, devastation and infrastructure problems in numerous residences as a result of the nocturnal offensive. As always, everyone still went about their day – enduring hostilities. But those full day encapsulated Ukraine's vital need on Western support – a reliance that neighboring countries are demonstrably unable to substitute in the near term.

Unsuccessful Negotiations

The 28-point plan from American leadership sparked intense emotion, discussion and profound anxiety – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after earlier high-level meetings and bilateral conferences.

Every new approach from US leadership unfolds according to the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, effectively counters. They stabilise the situation but never actually win the battle. This cycle will, undoubtedly, endure.

Tactical Assessments

It is tempting to accuse specific actors of repeatedly advocating Kremlin's demands. But that does not seem to be the entire situation. American leadership functions according to a premise familiar among seasoned negotiators: you cannot secure via talks what you have failed to defend militarily. The American government assumes that it is impossible to force Russia to abandon the land that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while acknowledging this situation, Washington does little to discourage Russia, through diplomacy or military means, from thinking that the status quo will not evolve additionally in its advantage in the months ahead.

Conflicting Perspectives

Therefore, the Kremlin is certain that the clock favors them – that Ukraine and its allies are coming close to fatigue. Their reason to accept conditions that does not give them the maximum possible gain is close to zero. There may be multiple initiatives to achieve ceasefire, but they will persist as long as Russia's government remains highly assured in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still persist, slowly losing civilians and areas but preventing a total frontline collapse until conditions improve in its favour.

Current Realities

Factually, there are no genuine requirements for a ceasefire. Now, individual motivations are becoming relevant: political desires to broker a ceasefire and obtain worldwide acknowledgment, and Kyiv's twin challenges – on one hand, not to alienate a key ally, and on the other, to unite the population around the flag against any proposal Kyiv finds unworkable, so that their focus does not switch to homefront challenges. And although their mission will now be significantly challenging after latest incidents, it remains very improbable that this will modify their basic position.

These two forces are driving the talks.

Assessment and Future

It took a just a single week to kill the suggested clauses of the current initiative. Assertive and inconsistent approach of the matter by American leadership, resistance by Ukraine and the rest of Europe, along with pacifying measures of negotiators, and finally, current information leaks, all served their function.

While new proposals based on old ideas are approaching, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to resist political attacks from Washington that are rooted in Kremlin requirements and reflect certain reluctance to change the course of events, if they stand together and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the predictable period, largely rely on continued Western support.
